Gratification

Gratification refers to all gifts received by Civil Servants or State Officials (Pn/PN). Therefore, gratification has a neutral meaning, and not all gratification is prohibited or wrong. Gratification is "a gift in a broad sense that includes money, goods, discounts, commissions, interest-free loans, travel tickets, accommodation facilities, tours, free medical treatment, and other facilities. Such gratification may be received domestically or abroad, whether conducted through electronic means or without electronic means." Explanation of Article 128 of Law No. 20/2001 on Amendments to Law No. 31/1999 on the Eradication of Criminal Acts of Corruption (Anti-Corruption Law).

The following are the criteria for prohibited gratification:

  • Gratification received is related to one's position.
  • The receipt is prohibited by applicable regulations, contradicts the code of ethics, involves a conflict of interest, or constitutes an improper/unreasonable receipt.

Why is gratification prohibited?

Because gratification is essentially "delayed bribery" or often referred to as "disguised bribery." PTC personnel who are accustomed to receiving prohibited gratification may eventually be drawn into other forms of corruption, such as bribery, extortion, and other corrupt practices. Therefore, gratification is considered the root of corruption. Such gratification is prohibited because it can lead PTC personnel to be non-objective, unfair, and unprofessional, preventing them from performing their duties properly. The law uses the term "gratification deemed as bribery" to indicate that the receipt of gratification related to one's position and contrary to one's obligations or duties.
